Rights / nation / accountability
Everyone Wants the French Revolution. Nobody Wants the Whole Inheritance.
The Republic’s vocabulary is not a museum collection. Its promises remain standards against which political power can be tested.
Existing essay carried forward into the revised collection. Further editorial revision is planned.
Free and equal in rights
Sovereignty resides in the nation
Law and participation
The right to demand an account
Who owns the word “people”?
Article 3 of the Declaration locates sovereignty in the nation. Article 6 identifies law as the expression of the general will and affirms citizens’ participation, personally or through representatives. These propositions leave a continuing institutional question: how is a people represented without one leader claiming to embody it completely? Conseil constitutionnel
A presidential majority, a parliamentary majority and a public demonstration are different forms of political expression. None can simply erase the others by saying “we are the people”. The argument concerns which procedure authorizes which decision. Conseil constitutionnel
Universal words, unequal histories
Article 1 declares human beings free and equal in rights. The history of colonial legal hierarchy demonstrates why a universal declaration cannot be treated as proof that a society universally practiced its principles. The gap is not a reason to abandon the principle; it is a reason to use it as a test. Conseil constitutionnelBernard Droz
Political rhetoric can invoke republican universality either to challenge unequal treatment or to declare discussion of inequality unnecessary. The same word then performs opposite tasks. Ask whether the appeal to universality opens an investigation or closes it. Conseil constitutionnelBernard Droz
Freedom of belief is not compulsory familiarity
Article 10 protects opinions, including religious opinions, subject to the public order established by law. Article 11 addresses free communication. These are not identical to a requirement that every religious expression receive public approval. Conseil constitutionnel
Nor should the Revolution be collapsed into the 1905 separation of churches and state. Different historical episodes, legal texts and forms of anti-clericalism must be distinguished. Invoking revolutionary violence against clergy as if it supplied today’s legal rule would confuse explanation with justification. Conseil constitutionnel
The article worth putting above a campaign stage
Article 15 states: “La société a le droit de demander compte à tout agent public de son administration.” Society has the right to demand an account from public agents. This moves the emphasis from reverence for office to the obligation of officeholders to answer. Conseil constitutionnel
The election is therefore not only a choice of who may exercise power. It is a choice about the institutions that make power answerable between elections. Public records, parliamentary scrutiny and independent legal review matter after the campaign’s most photogenic moment has passed. Conseil constitutionnel
